The laws and regulations in China and Europe require us to provide you with extensive information about data protection. Hereinafter you will find a brief summary of the most important contents of our Privacy Policy. In Section II. you can find a detailed Privacy Policy.

1.         What is the Privacy Policy about?

1.1.       In our Privacy Policy, we inform you how we process your Personal Information.

1.2.       Personal Information refers to all kinds of information that can be recorded by electronic or other means and which can identify individual natural persons alone or combined with other information, or reflect the activities of specific natural persons. This for example includes your name, your address, your email and your telephone number.

2.         Which Personal Information are we processing? For what purpose?

2.1.       We process your Personal Information to offer our services to you and to answer your enquiries. That includes:

  • Customer Relation Management, e.g. when you are interested in renting rooms in the German Centre Beijing or in other services of the German Centre Group: name, address and other contact information like your email address. In some instances we might process your job position;
  • Event Registration: name, email address and telephone number;
  • E-Mail newsletter: email address;
  • WeChat-channel, we receive from WeChat the following information: User Alias, Profile Photo, gender, region and location info.

2.2.       Apart from that we process different information to monitor the activities on our website, ensure the website is working properly and to improve our services. This includes the use of cookies, processing of protocol data or the use of tracking tools like Google Analytics.

2.3.       You can find more information about our processing activities in Art. 2 and 3 of our detailed Privacy Policy.

3.         Do we share Personal Information with third parties?

We only use your Personal Information for internal purposes and for our business relationship with you. In certain cases we use so-called data processors that support our activities with their services (this includes services to store information, technical support, marketing, analysis, customer relationship management and payment services). In certain cases, we share your Personal Information with our related companies.

We only share your Personal Information if legal provisions allow us to or you have given your consent. All our employees as well as our service providers are obliged to comply with the data protection regulations and our guidelines.

4.         Which measures do we take to protect your Personal Information?

4.1.       We use security measures that comply with industry standards to protect your Personal Information and to prevent unauthorized access, disclosure, unauthorized use, modification, damage or loss of your personal information.

4.2.       Before assigning a service provider to help us providing our services to you, we check its security measures and conclude an agreement that obliges the service provider to ensure an appropriate security level.

1.2.       The German Centre Beijing knows the importance of Personal Information to you and will do its best to protect your Personal Information safely and reliably. We are committed to maintaining your trust in us and following the principles of legality, justification and necessity, participation, openness and transparency to protect your Personal Information. At the same time, we take appropriate security measures to protect your Personal Information according to current security standards.

1.3.       Please read and understand the privacy policy carefully before using our services. By using our website and our services you agree to the processing of your Personal Information in accordance with this Privacy Policy. When using certain services, we will ask you additionally to consent to the processing of your information. If you do not agree with this Privacy Policy or do not consent once we additionally ask you, you cannot use our services.

2.         How we collect and use your Personal Information

2.1.       Personal Information refers to all kinds of information that can be recorded by electronic or other means and which can identify individual natural persons alone or combined with other information, or reflect the activities of specific natural persons.

2.2.       The German Centre Beijing will only collect and use your Personal Information for the following purposes described in this Privacy Policy:

2.2.1.    Customer Relation Management

We process your Personal Information for transacting, maintaining or establishing a customer or business relationship and for maintaining (other) business contacts between you and us or other members of the German Centre Group (German Centre for Industry and Trade GmbH, Beteiligungsgesellschaft, Stuttgart, German Centres Mexico, Moscow und Sin­ga­pore). These are personal details (name, address and other contact details like e-mail address). In some instances, we also process your job position. Your Personal Information is collected from you directly, for instance, when exchanging business cards or if you send a query or suggestions using a contact form or via e-mail.

2.2.2.    Event registration

You can register for events organized or conducted in the facilities of the German Centre Beijing via a registration tool on our website, using a contact form or via e-mail. In that case, we will store your name, email address and telephone number. When registering via the registration tool on our website we will additionally ask you for your consent to process your Personal Information.

2.2.3.    E-mail newsletter

You can register for our email newsletter via the registration function on our website. In that case, we will store and use your email address. We will only send you a copy of our newsletter if you have given us your consent to do so. To verify your acceptance, we will send you a link to confirm that you wish to receive the newsletter. Once you have done so, you can unsubscribe from the newsletter at any time. We will then delete your e-mail address from the list of recipients of our newsletter. Information on how to unsubscribe from the newsletter can be found at the end of the newsletter.

2.2.4.    German Centre WeChat channel

You can register for the German Centre WeChat channel to receive news and updates about our activities. When registering for our WeChat channel, WeChat will ask you for your consent, that we will be able to access the following Personal Information stored by WeChat: User Alias, Profile Photo, gender, region and location info. The Personal Information will not be available to us once you decide to unfollow our WeChat channel using the functions of WeChat.

2.3.       Additional information on the legal basis for data processing for persons residing in China

We will generally try to ask you for your consent before processing your Personal Information. Please be aware that in certain cases we are not required to ask you for your consent. These cases inter alia include:

  • The Personal Information is required to sign or perform a contract;
  • The Personal Information is required for the safe and stable operation of our services, such as discovering failures or bugs in our website;
  • The Personal Information collected originates from publicly available information, such as government authorities information;
  • You disclosed the Personal Information to the public by yourself;

Other circumstances as stipulated in laws and regulations.

2.4.       Additional information on the legal basis for data processing for persons residing in the European Union

The processing of your Personal Information for the purposes referred to in Article 2.2 is based on consent pursuant to Article 6 (1) p. 1 lit. a) GDPR. In individual cases, processing may be carried out for the performance of a contract or for the implementation of pre-contractual measures in accordance with article 6 (1) p. 1. b) GDPR. Where Personal Information is transferred from the European Union to China, the legal basis for this transfer is Article 49 para 1 P. 1 lit. b) GDPR.

2.5.       We generally process your Personal Information until you request removal or deletion of your Personal Information, except we are required to store the Personal Information by applicable laws and regulations. Furthermore, we will delete Personal Information once it is not necessary anymore to reach the above-mentioned purposes. 

2.6.       When we want to use your Personal Information for other purposes that we did not clearly state in our policy, we will ask for your consent beforehand.

3.         How we use Cookies and other tech­no­lo­gies

3.1.       Cookies

To ensure that our website works properly, we will store a small data file named Cookie on your computer or mobile device. A Cookie usually contains identifiers, site names, and some numbers and characters. We use cookies in interaction with your Internet browser in order to improve all our web pages at www.germancentre.cn. We do not use any technology that links up information in the cookies with your Personal Information.

If you visit our website we will store the so-called IP address of your computer for a short period. 3.3.       Protocoll data:

When you visit our website, our web servers store various data, for example:

  • the IP address of your PC (individual "address" of a PC in a computer network),
  • the pages you visit on our website,
  • the browser (for example, Internet Explorer) and operating system you use, and
  • the date and time of your visit.

We use the data on an anonymized basis for statistical purposes and in order to improve our website. This data cannot be traced back to you. We store the evaluated data on secure systems. This ensures that your privacy is protected at all times.

3.4.       Tracking Tools

3.4.1.    We store and analyze general data in connection with the use of our website. This data is called statistical data. It includes, for example, the number of visits to our website, information on which pages were visited and on session length. This allows us to maintain the safe and stable operations of our services. We evaluate the data on an anonymized basis and use it for statistical purposes and for our market research.

3.4.2.    We use Google Analytics, an Open Source software, for the statistical evaluation of visitor accesses, to collect the data. Google Analytics uses so-called cookies, text files stored on your computer, which allow an analysis of the way in which you use the website. The information generated by the cookie about your use of the web offerings is stored on our web servers in Germany. The IP address is anonymized immediately after processing, before it is stored. 3.5.       Utilites, active content

We use Java applets, Active X controls and Java script on our website. If you do not wish to use these utilities or active content for security reasons, you can disable the setting in your browser.

3.6.       Social Plugins

Our use the Social Plugin “LinkedIn Widget”, which make it easier to share or call up content on social networks. We use technical solutions designed to ensure that no contact with the servers of social network operators is established unless the Social Plugin is activated. By activating the deactivated Social Plugin you grant your consent to the transmission of data to the social network. On activation, data are transmitted to third parties.

Without activation no data transfer takes place to the operators of the social networks.

3.7.       Additional information on the legal basis for data processing for persons residing in China

The processing of your Personal Information for the purposes described in Articles 3.1 to 3.6 is necessary to ensure a safe and stable operation of our services, for example, to detect faults on our website. Please note that in this case we are not obligated to ask you for consent to the processing of this data. However, you can restrict this processing by using settings on your computer or browser as described above.

3.8.       Additional information on the legal basis for data processing for persons residing in the European Union

The processing of your Personal Information for the purposes described in Articles 3.1 to 3.6 is necessary for the purposes of our legitimate interests pursuant to Article 6 (1) p. 1 lit. f) GDPR. Our legitimate interest lies in the statistical evaluation of your user behavior, maintaining the security of our website and in order to continuously optimize our website and improve the marketing of our services.

4.         How we share, transfer and publicly disclose your Personal Information

4.1.       Sharing of your Personal Information

We will not share your Personal Information with any other third parties except as specified in this Privacy Policy, or in circumstances where you consent to such sharing of this Personal Information.

We share your Personal Information with selected recipients who have a legal basis within the applicable jurisdiction. These categories of recipients include:

We will not transfer your Personal Information to any company, organization or individual, except as specified below, or in circumstances where you consent to such transfer.

In the case of mergers and acquisitions, asset transfers or similar transactions, these may involve the transfer of your Personal Information. In such a case, we will require companies and organizations that receive your Personal Information to continue to be bound by this Privacy Policy. If the company or organization wishes to use the Personal Information for other purposes than described in this Privacy Policy, we will require it to ask you for your consent to process your Personal Information again.

4.3.       Public disclosure of your Personal Information

We will not disclose your Personal Information publicly, except in circumstances where you consent to such public disclosure or in the event that we must publicly disclose your Personal Information in accordance with the requirements of laws, regulations, mandatory administrative enforcement or judicial requirements.

5.         How we protect your Personal Information

5.1.       We use safety protection measures that meet the industry standards to protect your Personal Information and prevent it from unauthorized access, public disclosure, unauthorized use, modification, damage or loss. Our protection measures include for example:

  • our website www.germancentre.cn uses HTTPS browsing;
  • we use access control mechanisms and password protection to ensure that only authorized personnel can access Personal Information;
  • we host security and privacy protection training courses and enhance staff awareness for the importance of Personal Information protection.

5.2.       We take all reasonable and feasible measures to ensure that we only collect Personal Information necessary for our purposes.

5.3.       Please be aware that despite our efforts, no Personal Information security measures can guarantee one hundred per cent security at all times. We do not warrant or guarantee the security of our services or any information you provide to us through our website. However, if our physical, technical or management protection facilities are damaged and your Personal Information is subject to unauthorized access, public disclosure, tampering, or destruction, resulting in the damage of your legitimate rights and interests, we will take the corresponding legal responsibilities.

5.4.       In the unfortunate event of a Personal Information security incident, we will act in accordance with the requirements of laws and regulations. We will inform you in a timely manner about the basic situation of the security incident, measures we have taken or will take to deal with the incident and advice how you can prevent and reduce risks independently. We will inform you in time by mail, letter, telephone or push notice. If it is difficult for us to inform each person one by one, we will make an announcement in a reasonable and effective way.

6.         Your rights

In accordance with relevant laws, regulations and standards in China and other countries and regions, we ensure that you exercise the following rights for your Personal Information.

6.2.       Correct your Personal Information

When you find that we are dealing with your Personal Information wrong, you have the right to ask us to make corrections.

6.3.       Deletion of your Personal Information

In the following cases, you can request us to delete your Personal Information:

  • If we deal with your Personal Information in violation of laws and regulations;
  • If we collect and use your Personal Information, but have not received your consent;
  • if we deal with your Personal Information in violation of an agreement with you;
  • if you no longer use our services,
  • if we no longer provide you with services.

Except if we are under a legal obligation to store your Personal Information, we will delete your Personal Information within reasonable time (subject to technical limitations, e.g. necessary updates of databases). Upon responding to your request for deletion, we will also notify other entities and third parties who have obtained your Personal Information, requiring them to delete your Personal Information in time.

6.4.       Change the scope of your authorization

Each business function requires some basic Personal Information (see Article 2.2). For the collection and use of additional Personal Information, you have the right to revoke consent granted with effect for the future. This means that your personal data will no longer be processed for this purpose and will also be deleted. For example, you will then no longer receive our newsletters. Please note that that the revocation does not impact the legality of processing for which consent has been granted up to the revocation.

6.5.       Receive a copy of Personal Information stored by us

You have the right to receive a copy of your Personal Information stored by us.

To ensure security, you may need to provide a written request or prove your identity in other ways. We may first ask you to verify your identity and then reprocess your request.

6.7.       Additional information on User Rights for persons residing in China

In the following cases, according to the requirements of the laws and regulations, we will not be able to respond to your request:

  • It is directly related to the security of the state and the security of national defense;
  • It is directly related to public safety, public health and major public interests;
  • It is directly related to criminal investigation, prosecution, trial and decision enforcement.
  • there is sufficient evidence to show that you have for an abuse of rights;
  • the response to your request will lead to serious damage for the legitimate rights and interests of you or other individuals and organizations.

If you are residing in the European Union, the legal bases for your rights are as follows or you can refer to the following rights in addition to the rights shown in Articles 6.1 to 6.6. The restrictions under § 34 and § 35 BDSG apply to the right of information and to the cancellation request. In addition, you have a right of appeal to a Data protection supervisory authority under article 77 GDPR in conjunction with § 19 BDSG.

7.         How do we deal with children's Personal Information

Our website and services are mainly for adults. Children are not allowed to use the services provided without the consent of the parents or guardians. For children's Personal Information collected with their parents' consent, we will only disclose this information when permitted by law or the parents or guardians explicitly consent.

Although local laws and customs have different definitions of children, we regard any person under the age of 14 as a child.

If we find ourselves collecting children's Personal Information without prior confirmation of their parents' consent, we will try to delete relevant data as soon as possible.

8.         How does your Personal Information shift around the world

In principle, we process Personal Information in the People's Republic of China.

Because we provide products or services through global resources and servers, we may transfer your Personal Information to and it may be accessed in other countries and overseas jurisdictions.

There may be different data protection laws in such jurisdictions or relevant laws are not set up. In this case, we will ensure that your Personal Information is equally protected as in the People's Republic of China.

9.2.       Without your explicit consent, we will not reduce your rights in accordance with this privacy policy. We will publish any changes to this Privacy Policy on this website.
